Alabama Security Deposit Return: The 60-Day Deadline (2026)

How long a landlord has to return your deposit, and what you can claim if they miss it

At a glance

Who this covers — and who it does not

This page covers residential security deposits in Alabama, where a landlord has kept some or all of a deposit after a tenancy ends.

It does not cover:

Lease terms and local ordinances can change what applies. Where a city has its own deposit rules, those may differ from the state statute below.

What the statute actually says

60days

Measured from Termination of the tenancy and delivery of possession.

The landlord must return the deposit, minus itemized deductions (accrued rent + damages from tenant noncompliance with § 35-9A-301), in a written notice delivered within 60 days after termination of the tenancy and delivery of possession. NOTE: the 60-day period reflects Act 2014-279; the original 2006 act said 35 days. The current law is 60 days.

Penalties

Working out your own deadline

The clock does not start on the day you decided to leave. In Alabama it starts Termination of the tenancy and delivery of possession — for most leases that is the date you hand back the keys, not the date your notice period began.

  1. Find the date you vacated and returned the keys. Write it down; everything else depends on it.
  2. Add 60 calendar days. Count calendar days, not business days.
  3. If the landlord has provided a forwarding address, check the statute for whether the deadline is shortened — in some states it is.
  4. Note the date the deadline falls on. If the deposit has not arrived by then, the clock for the penalty starts running.

Common landlord defences and how to answer them

““You never gave me a forwarding address.””

Even without my address, you must still mail the refund or accounting to my last known address (or the property address). A deposit only becomes forfeited if I leave it unclaimed for 90 days. That does not excuse your 60-day itemization obligation.

Ala. Code § 35-9A-201(d)

““I deducted for cleaning and damages.””

You must provide an itemized list of withheld amounts within 60 days. If you fail to mail a timely refund or accounting, you owe me double my original deposit under § 35-9A-201(f).

Ala. Code § 35-9A-201(c), (f)

““I charged two months' rent as a deposit.””

Alabama caps the base security deposit at one month's rent. Any excess is only lawful for pets, tenant-requested changes, or increased liability risk — none of which apply here.
