How long a landlord has to return your deposit, and what you can claim if they miss it
This page covers residential security deposits in Oklahoma, where a landlord has kept some or all of a deposit after a tenancy ends.
It does not cover:
Lease terms and local ordinances can change what applies. Where a city has its own deposit rules, those may differ from the state statute below.
Measured from Termination of the tenancy, delivery of possession, AND written demand by the tenant.
If the landlord proposes to retain any portion of the deposit, the landlord must return the balance within 45 days after termination of tenancy, delivery of possession, and written demand by the tenant. NOTE: the 45-day period reflects the current statute; older sources cite 30 days. If the tenant makes no written demand within 6 months, the deposit reverts to the landlord.
Okla. Stat. tit. 41, § 115(B) ↗No statutory penalty beyond returning the deposit.
Oklahoma has NO 2x or 3x civil multiplier for deposit noncompliance. The remedy (§ 115(E)) is recovery of the deposit and prepaid rent itself. Separately, § 115(A) criminalizes MISAPPROPRIATION of the escrowed deposit (up to 6 months jail + a fine up to twice the amount misappropriated) — but that is a criminal penalty, not a tenant's civil recovery.
Okla. Stat. tit. 41, § 115(E) ↗The clock does not start on the day you decided to leave. In Oklahoma it starts Termination of the tenancy, delivery of possession, AND written demand by the tenant — for most leases that is the date you hand back the keys, not the date your notice period began.
““You never made a written demand.””
You are correct that the 45-day clock requires my written demand — here it is, in writing, effective now. Once demanded, the 45-day period to itemize and return my deposit runs from termination, delivery of possession, and this demand.
Okla. Stat. tit. 41, § 115(B)
““I deducted for damages.””
You must itemize any retention in a written statement. If you failed to comply with § 115, I am entitled to recover my deposit and any prepaid rent in full under § 115(E).
Okla. Stat. tit. 41, § 115(B), (E)
““I did not have to hold it in escrow.””
Under § 115(A), my deposit must be held in an escrow account with a federally insured institution. Misappropriating it is a criminal offense punishable by jail time and a fine.
