How long a landlord has to return your deposit, and what you can claim if they miss it
This page covers residential security deposits in Rhode Island, where a landlord has kept some or all of a deposit after a tenancy ends.
It does not cover:
Lease terms and local ordinances can change what applies. Where a city has its own deposit rules, those may differ from the state statute below.
Measured from The later of: termination of the tenancy, delivery of possession, or the tenant providing a forwarding address.
The landlord must deliver a written itemized notice, together with the amount of deposit due, within 20 days after the LATER of termination of the tenancy, delivery of possession, or the tenant's providing a forwarding address for receiving the deposit.
R.I. Gen. Laws § 34-18-19(b) ↗A landlord who withholds in bad faith may be liable for 2x the portion wrongfully withheld.
If the landlord fails to comply with the return requirement, the tenant may recover the amount due plus damages equal to TWICE the amount wrongfully withheld, and reasonable attorney fees. No bad-faith finding is required.
R.I. Gen. Laws § 34-18-19(c) ↗The tenant may recover the landlord's attorney fees.
Reasonable attorney fees are recoverable on the landlord's failure to comply with the return requirement.
R.I. Gen. Laws § 34-18-19(c) ↗The clock does not start on the day you decided to leave. In Rhode Island it starts The later of: termination of the tenancy, delivery of possession, or the tenant providing a forwarding address — for most leases that is the date you hand back the keys, not the date your notice period began.
““You never gave me a forwarding address.””
Here is my forwarding address now. The 20-day clock runs from the later of termination, possession, or my providing this address — so it starts now.
R.I. Gen. Laws § 34-18-19(b)
““I deducted for damages.””
You may deduct only unpaid rent, reasonable cleaning and trash-disposal expenses, and physical damage beyond ordinary wear and tear, itemized in a written notice. If you failed to comply, I may recover twice the amount wrongfully withheld plus attorney fees.
R.I. Gen. Laws § 34-18-19(b), (c)
““I'll keep the deposit and you can sue me.””
Failure to return my deposit on time entitles me to the amount due plus twice the amount wrongfully withheld, and reasonable attorney fees.
R.I. Gen. Laws § 34-18-19(c)
