This page covers the eviction process in New Jersey for a residential tenancy — the notices a landlord must serve, the timeline, and what you can do at each stage.

It does not cover commercial leases, or mobile home parks where a separate statute applies. Where a city has its own rules, those may differ from the state statute below.

What the statute actually says

N.J.S.A. 2A:18-61.1 — 驱逐（Anti-Eviction Act）须有正当理由：房东仅能依 18 项法定事由驱逐或拒续约，且仅法院 warrant 由 Special Civil Part Officer 执行。

新泽西是 just-cause 驱逐州。欠租（a）无需诉前 notice to quit；disorderly/damage 须 notice to cease + 3 天；违约/habitual late 须 notice to cease + 1 个月；owner move-in 2 个月。租约 waive 保护条款无效（2A:18-61.4）。

How the process runs, step by step

1. 房东确认法定事由 + 送达 notice to cease / notice to quit (from 法定事由发生). 欠租无需通知；disorderly/damage 3 天；违约/habitual late 1 个月。
2. 房东向 Superior Court Landlord-Tenant 提起驱逐之诉 (from 通知期届满). 通知期届满后起诉；欠租案租客可 pay-and-stay 赎回。
3. 法院 warrant for removal + Special Civil Part Officer 执行 (from 判决). 仅法院 warrant 由 court officer 执行；租客可依 hardship 申请最长 6 个月缓执行（2A:42-10.6）。

新泽西禁止自力救济（2A:39-1）：房东不得换锁、拆门窗、搬物；断水电属 disorderly persons offense（2C:33-11.1，最高 6 个月监禁）。
